1. Acceptance of Terms

By accessing or using FieldGility (the "Service"), operated by FieldGility ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FieldGility is a field service management platform that provides tools for scheduling, dispatching, customer management, invoicing, estimating, employee management, and related business operations for lawn care and landscaping companies. The Service includes a web application, mobile web interface, client portal, and API.

3. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You may sign in using Google OAuth. By doing so, you authorize us to access the Google account information described in our Privacy Policy.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code, viruses, or harmful content
  • Scrape, crawl, or use automated means to access the Service without permission
  • Resell or redistribute access to the Service without authorization

5. Your Data

You retain ownership of all data you enter into the Service (customer records, job data, invoices, etc.). We do not claim ownership of your content. You grant us a limited license to store, process, and display your data solely to provide the Service.

You are responsible for the accuracy and legality of data you enter. You must have appropriate consent to store personal information about your customers and employees.

6. Third-Party Integrations

The Service may integrate with third-party services such as Google (Gmail, Maps), Stripe, and GoHighLevel. Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for third-party service availability or conduct.

7. Payment & Billing

Certain features of the Service may require a paid subscription. Fees, billing cycles, and payment terms will be communicated at the time of purchase. We reserve the right to change pricing with reasonable notice. Payments are processed through Stripe and are subject to Stripe's terms.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss resulting from service downtime.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDGILITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
